Medicare beneficiaries may qualify for a Special Enrollment Period (SEP) when they join or drop employer or union-sponsored health and/or drug coverage, regardless of whether the coverage is considered creditable. This SEP applies to both current employer coverage and retiree plans.
Understanding SEP #5
Eligibility Criteria:
You qualify for SEP #5 if you:
- Enroll in or disenroll from an employer or union-sponsored Medicare Advantage Plan or Part D plan.
- Drop an employer/union health plan (including COBRA) to enroll in a Medicare Advantage Plan or Part D plan.
- Switch from an employer/union plan to another Medicare plan.
This SEP applies whether the employer/union coverage is active or from a former employer (retiree coverage).
Duration of SEP #5
- When It Starts: The SEP begins when your employer or union coverage ends.
- When It Ends: The SEP continues for two months after the month your employer or union coverage ends.
Effective Date of Coverage
- Your new Medicare Advantage or Part D coverage can start as early as the first day of the month after you submit your enrollment application.
- If your employer or union plan was late in submitting necessary paperwork, your coverage might start retroactively to the date you submitted your application.
Examples Relevant to Las Vegas and Henderson, Nevada
- Transitioning from Active Employment:
Maria, a Las Vegas resident, retires from her job at a hotel on the Strip, where she had employer health coverage. She wants to enroll in a Medicare Advantage plan. Since her employer coverage ends on June 30, she has until August 31 to enroll in a Medicare plan using SEP #5. - Dropping Retiree Coverage:
John from Henderson has retiree health coverage through his former employer. After reviewing costs, he decides to drop his retiree plan and enroll in a standalone Part D drug plan. His SEP lasts for two months after the month his retiree plan ends, giving him ample time to make the switch. - COBRA Coverage Ending:
Linda, who lives in Clark County, was on COBRA after leaving her job. Her COBRA ends in September. She can enroll in a Medicare Advantage plan anytime from when her COBRA ends through November 30.
Key Considerations
- Act Promptly: Missing the SEP window can result in delays or penalties.
- Understand Coverage Overlap: In some cases, employer/union coverage may work alongside Medicare. Review how the plans coordinate before making changes.
- Seek Professional Guidance: Medicare rules can be complex, especially when transitioning from employer or retiree coverage.
