Understanding Special Enrollment Period #1: Losing Creditable Drug Coverage
For Medicare beneficiaries in Las Vegas, Henderson, and throughout Clark County, Nevada, maintaining prescription drug coverage is essential for managing healthcare costs. However, unforeseen circumstances can lead to the loss of creditable drug coverage. Fortunately, Medicare provides a Special Enrollment Period (SEP) for individuals who lose their creditable drug coverage through no fault of their own or wish to maintain or enroll in alternative creditable coverage.
What Is Creditable in Drug Coverage?
Creditable drug coverage refers to prescription drug plans that are considered as good as or better than Medicare Part D. This includes employer-sponsored drug plans, retiree coverage, TRICARE, VA benefits, or state pharmaceutical assistance programs. If you lose this type of coverage involuntarily, you may qualify for SEP #1.
Eligibility for This SEP
You are eligible for this SEP if:
- You lose creditable drug coverage through no fault of your own (e.g., your employer discontinues coverage or you lose Medicaid eligibility).
- Your drug coverage is reduced to the point where it no longer meets Medicare’s creditable standard.
- You wish to disenroll from Medicare drug coverage to maintain or enroll in another type of creditable coverage, such as TRICARE, VA benefits, or a state assistance program.
Important Note: This SEP does not apply if you lose your drug coverage due to non-payment of premiums.
How Long Does This SEP Last?
- If you receive notice that your coverage is ending, your SEP begins the month you are notified and lasts for two months after your coverage ends or two months after receiving the notice, whichever is later.
- If you voluntarily choose to disenroll from Medicare drug coverage to enroll in an alternative creditable plan, your SEP is available whenever you become eligible for the new plan.
Effective Date of New Coverage
- Your new plan begins on the first day of the month after submitting a completed application.
- You can request a delayed start of up to two months after your SEP ends if needed.
Examples of How SEP #1 Applies in Las Vegas & Henderson
Scenario 1: Employer Plan Discontinues Coverage
Mike, a 67-year-old retiree living in Henderson, was covered under his former employer’s retiree drug plan. In December, he receives a notice that his employer is discontinuing prescription drug coverage as of March 31. Because this loss is beyond his control, Mike qualifies for SEP #1 and can enroll in a Medicare Part D plan anytime from December through May 31 (two months after his coverage ends in March).
Scenario 2: Medicaid Coverage Loss

- Compare Plans Carefully: Not all Part D plans cover the same medications. Be sure to compare formularies, premiums, and pharmacy networks before choosing a new plan.
- Medicare Advantage Plans: If you have a Medicare Advantage plan that includes drug coverage (MAPD) and lose creditable coverage, you can either switch to another MAPD plan or enroll in a stand-alone Part D plan with Original Medicare.
